PRICE Our prices are for the members of the wholesale trade only and are FOB our nursery. Prices are subject to change without notice. A 30% deposit must be paid to hold an order. There will be a 20% restocking fee on pulled orders. CONDITIONS OF SALE All liability ceases after plants are loaded for delivery. We shall be glad to rectify any mistake made by us, but in no case will our liability be for an amount greater than the purchase price. Any unsatisfactory stock must be reported to us immediately and held for advice from us as to disposition. In any event, all claims must be made in writing within 24 hours of receipt of the product. TERMS OF PAYMENT Our terms are cash upon pick-up or delivery. Once established with our business, credit may be obtained. Credit terms are limited to net 30 days. A 1.5% per month interest rate is charged to all past due accounts. There is a $30 charge for all NSF checks. Buyer agrees to pay reasonable attorney's fees and other costs of collection. |
 NON-WARRANTY We exercise care to have all plants true to name. Nevertheless, we give no warranty, expressed or implied, as to the variety, life or productivity of nursery stock we sell and are not responsible for the results obtained in transplanting. Liability in all instances is limited to the purchase price. No liability is assumed by seller for delay or failure to deliver caused by contingencies beyond seller's control including but not limited to such things as wars, strikes, fires, floods, droughts, embargoes and acts of God. |
